These Terms of Use (the “Terms”) govern your access to and use of the Health Diary mobile application (the “App”), provided by the team behind pickrabbit.net (“we”, “our”, “us”).
Please read these Terms carefully before using the App. By downloading, accessing, or using Health Diary, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.
Health Diary is a personal health journaling and tracking application designed to help you record how your body feels, view trends over time, and prepare for conversations with healthcare professionals.

If you are using the App on behalf of another person (for example, a family member), you represent that you are authorized to do so and that you accept these Terms on their behalf.
Health Diary is not designed for children under 13 years of age (or the minimum age in your jurisdiction). By using the App, you represent that you are at least 13 years old, or that you are of sufficient age and capacity under the laws of your jurisdiction to use the App.
If we learn that we have allowed a child under the applicable minimum age to create an account or use the App in violation of these Terms, we may take reasonable steps to deactivate the account and remove associated information where appropriate.
Health Diary is not a medical device and does not provide medical diagnosis, treatment, or professional medical advice.
The App is intended for personal tracking, journaling, and awareness only. Any summaries, patterns, trends, or suggestions offered by the App, including those generated by AI, are:

Health Diary offers:
All purchases, billing, and refunds for the App are handled by Apple through the App Store using StoreKit, and are subject to Apple’s terms and policies. We do not process your payment card information.
By purchasing a subscription or lifetime plan, you agree to:
If you purchase a subscription, it may be set to renew automatically at the end of each billing period (e.g., monthly or yearly) unless you cancel at least 24 hours before the end of the current period.
You can manage or cancel your subscription at any time via your App Store account settings. We cannot cancel subscriptions on your behalf.
We may change the prices of subscriptions or the features associated with each plan from time to time. If we do, we will follow the requirements of the App Store platform regarding notice and consent for price changes.
Your continued subscription after the new price takes effect may constitute acceptance of the new price. If you do not agree with a price change, you must cancel your subscription before the next billing date.

Health Diary may rely on third-party services to provide certain features, such as artificial intelligence (AI) processing, weather data, crash reporting, and advertising.
We may use third-party AI models, such as ChatGPT 4.1 mini model API (provided via OpenAI infrastructure and/or Apple’s integrated AI services), to:
By using AI features, you acknowledge that relevant parts of Your Content are sent to these AI services for processing, and that results are based on statistical patterns rather than professional medical judgment.
We may use third-party weather APIs to retrieve environmental data (such as temperature and humidity) for the purpose of correlating your entries with weather conditions. Your approximate location or region may be used to query these services.
The free version of the App may display third-party advertisements. Ad networks may collect certain device and usage information as described in our Privacy Policy. If you purchase an ad-free plan, we will stop requesting ads for your account on that device.
Use of these third-party services is subject to their own terms and privacy policies, which we do not control.
Your use of the App is also governed by our Privacy Policy, which explains in detail how we collect, use, and protect your information, and how third-party services (including AI providers, weather APIs, and ad networks) are involved.
By using the App, you acknowledge that you have read and understood our Privacy Policy and consent to the data practices described in it.
If there is a conflict between these Terms and the Privacy Policy in relation to data handling, the Privacy Policy will generally govern how we handle your personal information, while these Terms will govern your use of the App and our relationship more broadly.
The App, including its design, user interface, graphics, logos, trademarks, text, and underlying software, is owned by us or our licensors and is protected by intellectual property laws.
Except for the limited license granted to you in Section 7, these Terms do not grant you any rights to:

The App and all of its features are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied.

Where permitted by law, you agree that any disputes will be resolved through good-faith negotiations. If the parties cannot reach a resolution, disputes may be brought before a competent court in a jurisdiction permitted by applicable law.
